These Terms of Use (“Terms of Use”) govern your access to and use of the Aesthetic Engine software platform, tools, and related technology services (the “Platform”). The Platform is operated by Carrie Krane LLC, doing business as Aesthetic Engine (“Aesthetic Engine,” “we,” “us,” or “our”).
By accessing or using the Platform, you agree to these Terms of Use. If you do not agree, do not access or use the Platform.
1. Platform Access & License
Aesthetic Engine provides access to a cloud-based software platform that includes business systems, scheduling, forms, messaging tools, websites, and automation features.
You are granted a limited, non-exclusive, non-transferable license to access and use the Platform during your active subscription, solely for your own business purposes.
You may not:
- Resell, sublicense, or share access to the Platform
- Reverse engineer or copy platform systems
- Use the Platform for unlawful, abusive, or prohibited purposes
2. Account Responsibility
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Ensuring information entered into the Platform is accurate and lawful
Aesthetic Engine is not responsible for unauthorized access caused by your failure to secure your account credentials.
3. Acceptable Use
You agree not to use the Platform to:
- Violate any laws or regulations
- Send spam, abusive, misleading, or unlawful communications
- Misuse messaging systems or violate carrier rules
- Infringe on intellectual property rights
- Attempt to bypass platform safeguards or restrictions
Aesthetic Engine reserves the right to suspend or terminate access for misuse, abuse, or violations of these Terms.
4. Messaging, Communications & Usage-Based Features
Certain Platform features, including phone numbers, SMS/MMS messaging, email sending, and phone calls, operate on a usage-based (pay-as-you-go) model.
You acknowledge that:
- Messaging and communication features incur additional fees based on usage
- Rates may vary based on carrier and vendor pricing
- Messaging credits may be provided and do not roll over or have cash value
You are responsible for monitoring your usage within the Platform. You can view the usage costs here.
5. HIPAA & Data Responsibility
While Aesthetic Engine maintains a HIPAA-compliant technology infrastructure, you are solely responsible for:
- How you use the Platform
- Ensuring your communications, workflows, and data handling comply with HIPAA and applicable laws
- Your own clinical, privacy, and regulatory obligations
Use of the Platform alone does not guarantee compliance.
6. Availability & Modifications
The Platform is provided “as is” and “as available.”
Aesthetic Engine may:
- Modify, update, or improve Platform features
- Temporarily suspend access for maintenance or security
- Discontinue features with reasonable notice
We do not guarantee uninterrupted or error-free operation.
7. Suspension & Termination
Aesthetic Engine may suspend or terminate Platform access if:
- Payment fails or is not resolved
- These Terms are violated
- Required fees are unpaid
- Use poses risk to the Platform, carriers, or other users
Termination does not relieve you of outstanding payment obligations.
8. Intellectual Property
All Platform technology, systems, templates, workflows, and software are the property of Carrie Krane LLC.
You do not acquire ownership of any Platform components through use.
9. Disclaimer of Warranties
The Platform is provided without warranties of any kind, express or implied.
Aesthetic Engine does not guarantee results, business outcomes, or performance.
10. Limitation of Liability
To the maximum extent permitted by law, Aesthetic Engine shall not be liable for indirect, incidental, or consequential damages arising from Platform use.
Total liability shall not exceed the amount paid by you to Aesthetic Engine in the preceding 12 months.
11. Governing Law
These Terms of Use are governed by the laws of the State of California.
